Divorce mediation is a confidential, voluntary process where a neutral third-party mediator helps a divorcing couple negotiate and reach a mutually agreeable settlement on issues like child custody, property division, and financial support. This process allows you to make the important decisions instead of going to the Courts for a Judge to decide. This cooperative approach emphasizes open communication and compromise, allowing the couple to maintain control over the outcome and often leading to a resolution that is less expensive, faster and less emotionally draining than traditional litigation.

In divorce mediation, a neutral third party mediator helps guide the couple to a mutually acceptable settlement outside of the Courts. In litigation, each spouse hires their own attorney and a judge will make the final decisions on contested issues.
In mediation, the couple retains full control over the final agreement. In litigation, a judge makes the final, legally binding decisions based on New York State Law which means the outcome is in a stranger's hands.
Divorce mediation is designed to be controlled by the couple involved; not the Court system. This means your divorce could be settled in a few sessions or, spread out over a few months; whichever you prefer. You are in control.
Mediation is a collaborative and non-adversarial process. It is focused on finding common ground and making agreements that are good for both spouses and the children. Litigation is adversarial and contentious and is designed so each spouse's attorney fights's for their individual client's rights.
In determining child custody, the Court s consider several factors, including the child's age, health, and well-being, the relationship between the child and each parent, and the ability of each parent to provide for the child's physical and emotional needs.
Mediation allows for the parents to make these decisions, not the Court.
Mediation is typically faster and less expensive than a litigated divorce. Often, a mediated divorce can be resolved in a matter of months. Litigation can take years of fighting due to the nature of the adversarial process, court schedules and formal procedures.
Generally, mediation is more cost effective than a litigated divorce. In Mediation, the couple pay for the neutral mediator's time to secure an amicable agreement; not two separate attorneys designed to escalate the conflicts.
